ALPWEAR — TERMS OF SERVICE
Last updated: 29 August 2026
1. ABOUT ALPWEAR AND THESE TERMS
These Terms of Service (“Terms”) govern your use of the ALPWEAR website, online store, customer account features and purchases made through our online store.
ALPWEAR is operated by:
Trade name: Alpwear
Legal form: Sole proprietorship (eenmanszaak)
Chamber of Commerce (KvK): 98292935
VAT ID: NL005322056B72
Business address: Christiaan van der Takstraat 18, 2662 JG Bergschenhoek, The Netherlands
Email: alpwearclothes@gmail.com
Phone: +31 6 13 26 92 39
Our online store is powered by Shopify. Shopify provides the ecommerce infrastructure, but your purchase agreement for ALPWEAR products is with ALPWEAR unless explicitly stated otherwise.
These Terms are supplemented by the information shown on the relevant product page and at checkout, as well as our Returns & Refunds Policy, Shipping Policy and Privacy Policy.
If a provision of these Terms conflicts with mandatory consumer law, the mandatory law prevails. For a specific purchase, product-specific information and terms clearly disclosed before checkout prevail over these general Terms to the extent of any direct conflict.
2. USE OF THE WEBSITE AND CUSTOMER ACCOUNTS
You must use the website and Services lawfully.
If applicable law requires you to have the consent of a parent, guardian or other legal representative to enter into a purchase agreement, you may only place an order if you have that required consent.
You are responsible for providing accurate, current and complete information when placing an order or creating an account.
You are responsible for keeping your account credentials secure and for activity carried out through your account, except where such activity results from circumstances for which ALPWEAR is legally responsible.
You may not use another person’s identity, payment details or account without authorization.
3. PRODUCT INFORMATION
We aim to present our products, colours, materials, sizing, features and other product information as accurately as reasonably possible.
Because screens, lighting conditions and device settings differ, the colour or appearance of a product on your device may differ slightly from the physical product.
Minor variations that are normal for textiles and garment production may occur, including small variations in stitching, embroidery, print placement, dye tone or measurements, provided that the product still conforms to the agreement and to what a consumer may reasonably expect.
Nothing in these Terms limits your statutory rights where a product is defective, incorrect or otherwise does not conform to the agreement.
Editorial, cultural, historical and Archive-related storytelling on our website is intended as brand and informational content. Unless expressly identified as a contractual product specification, such editorial content does not create an additional product warranty or guarantee.
4. AVAILABILITY, DROPS AND PURCHASE LIMITS
All products are subject to availability.
We may discontinue products, colourways or sizes, change future collections, or decide not to restock an item.
Before an order is accepted, we may apply reasonable purchase limits per customer, household, account, payment method or address, particularly for limited releases, promotions or suspected bulk purchasing.
Stock information can occasionally be affected by technical or inventory-sync errors. If a product becomes unavailable after an order has been placed, we will contact you and provide an appropriate solution. Where we cannot supply the ordered item, we may cancel the affected item and refund the amount paid for it, subject to applicable law.
We will not substitute a materially different product without your agreement.
5. PRICES, TAXES AND OBVIOUS ERRORS
Prices shown to consumers include VAT where required by law.
Any shipping costs, optional services or other charges that depend on the order are shown separately before the order is completed.
The price applicable to your order is the price displayed and agreed at checkout, subject to the rules below regarding obvious errors.
We may change prices, promotions and discounts for future orders at any time.
If a displayed price contains a clear and unmistakable error and you knew or should reasonably have understood that the price could not be correct, we may correct the error and cancel the affected order. If payment has already been received, the amount paid for the cancelled item will be refunded.
We will not rely on this clause for a minor or non-obvious pricing mistake where a consumer could reasonably rely on the displayed price.
6. ORDERS AND CONTRACT FORMATION
By submitting an order, you request to purchase the selected products on the terms displayed during checkout.
Unless the checkout or order confirmation expressly states otherwise, the purchase agreement is concluded when ALPWEAR sends you an order confirmation that confirms the purchase.
An automated message that only acknowledges receipt of an order, without confirming acceptance, does not necessarily constitute acceptance.
After an order has been accepted, ALPWEAR may only cancel or modify it where there is a valid legal or contractual reason, including where:
• payment authorization fails or payment is reversed;
• the order is affected by a clear and unmistakable pricing or technical error;
• a genuine stock or inventory error makes delivery impossible;
• we have reasonable grounds to suspect fraud, unauthorized payment, identity misuse or unlawful activity;
• the order violates a legally permitted purchase limit or clearly documented promotion condition;
• fulfilling the order would violate applicable law, sanctions, export restrictions or carrier restrictions; or
• another circumstance gives us a lawful right to cancel the order.
Where we cancel an accepted consumer order and you are entitled to a refund, we will refund the relevant amount using the original payment method unless otherwise agreed or legally permitted.
We do not have an unrestricted right to cancel a valid consumer order merely because we later prefer not to fulfil it.
7. FRAUD, ABUSE AND COMMERCIAL BULK ORDERS
ALPWEAR may use reasonable measures to protect the store, customers and payment systems against fraud and abuse.
Before accepting an order, we may refuse or limit an order where we have reasonable grounds to believe it involves:
• fraudulent or unauthorized payment;
• identity misuse;
• automated purchasing intended to bypass purchase limits;
• manipulation or repeated misuse of discount codes;
• abusive chargeback activity;
• unlawful conduct; or
• commercial bulk purchasing or resale activity that conflicts with a clearly disclosed sales restriction.
Nothing in this section limits any lawful resale rights you may have after you have validly acquired ownership of a product.
8. PAYMENT
Available payment methods are displayed at checkout and may change over time.
You agree to provide valid and authorized payment information.
Some payment methods are provided by independent payment service providers. Additional terms from those providers may apply to your use of their payment services.
An order may be delayed or cancelled where payment is not successfully authorized or completed.
Any statutory rights you have in relation to unauthorized payments or payment-provider disputes remain unaffected.
9. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes may be subject to additional conditions displayed when the promotion is offered.
Unless otherwise stated:
• discounts apply only during the stated promotion period;
• discount codes cannot be exchanged for cash;
• a discount cannot be applied retroactively to an order that was completed before the discount became available;
• multiple discount codes cannot be combined unless checkout permits this; and
• we may refuse the use of a promotion where there are reasonable grounds to conclude that the promotion is being used fraudulently or contrary to its clearly disclosed conditions.
Ending or changing a promotion affects future orders only and does not retroactively change the agreed price of an already concluded order.
10. SHIPPING AND DELIVERY
Processing times, estimated delivery times, shipping methods and shipping costs are described in our Shipping Policy and/or displayed during checkout.
Delivery dates and transit times identified as estimates are not guaranteed delivery appointments.
ALPWEAR remains responsible for the risk of loss or damage during delivery until the goods are delivered to you or to a person designated by you, except where applicable law provides otherwise.
If you independently instruct a carrier that was not offered by ALPWEAR, risk may pass at the point permitted by applicable law.
You are responsible for providing a complete and accurate delivery address.
If an order cannot be delivered because you supplied an incorrect or incomplete address, or because you request re-delivery after a failed delivery attributable to you, we may charge reasonable additional re-shipping costs where permitted by law and where those costs are disclosed before re-shipment.
If we are unable to deliver within the agreed or legally required period, your statutory rights regarding delayed or failed delivery remain unaffected.
11. PRE-ORDERS, BACKORDERS AND RESTOCK ITEMS
A product may only be treated as a pre-order, backorder or restock item where this is made clear before you complete the purchase.
Estimated production, restock or dispatch dates are estimates unless explicitly described as a guaranteed date.
Delays may occur due to production, quality control, transport, customs or other supply-chain circumstances.
If a material delay occurs, we may provide an updated estimate. Your statutory rights regarding delayed delivery, cancellation and refunds remain unaffected.
Nothing in this section allows ALPWEAR to keep payment indefinitely where we cannot deliver the ordered product.
12. RIGHT OF WITHDRAWAL AND RETURNS
Returns and refunds are governed by our Returns & Refunds Policy and mandatory consumer law.
For eligible online consumer purchases, statutory withdrawal rights apply.
ALPWEAR’s current Returns & Refunds Policy provides a 15-day period after receipt in which an eligible return may be requested, subject to the conditions stated in that policy and any more favourable mandatory rights that apply.
For change-of-mind returns, the customer is responsible for arranging and paying the direct return shipping costs where this was properly disclosed before purchase.
Where the complete order is validly withdrawn under statutory consumer law, original standard delivery costs are refunded where required by law. Where only part of an order is returned, original delivery costs are not refunded unless applicable law requires otherwise.
The statutory online cooling-off period generally does not apply to a purchase concluded entirely in a physical store. Any voluntary in-store return arrangement is separate from the statutory online withdrawal right.
Nothing in these Terms limits rights relating to defective, damaged or non-conforming products.
13. CONDITION OF RETURNS AND DIMINISHED VALUE
For a change-of-mind return, you may inspect and try on a product to the extent reasonably necessary to determine its nature, characteristics and fit.
If you handle or use a product beyond what is reasonably necessary for that purpose, ALPWEAR may apply a reduction in the refund corresponding to the resulting loss in value, where permitted by law.
Normal fitting does not by itself remove a statutory withdrawal right.
Products should be returned clean and, where reasonably possible, with their original tags and packaging.
For detailed return instructions and the return address, see our Returns & Refunds Policy.
14. STATUTORY GUARANTEE AND NON-CONFORMING PRODUCTS
Consumers are entitled to the statutory guarantee of conformity.
A product must have the characteristics and quality that you may reasonably expect on the basis of the agreement, the product description, relevant statements made before purchase, its price and its intended normal use.
If a product is defective or does not conform to the agreement, contact ALPWEAR.
Where the legal conditions are met, ALPWEAR will provide the remedy required by applicable consumer law, which may include repair, replacement, price reduction or termination/refund.
Statutory guarantee rights do not cover damage caused by circumstances for which the consumer is responsible, such as improper use, accidental damage, failure to follow reasonable care instructions or normal wear and tear, to the extent permitted by law.
Nothing in these Terms shortens or excludes the statutory guarantee period or changes the statutory burden of proof to the consumer’s disadvantage.
15. PRODUCT CARE
Customers should follow the washing, care and use instructions supplied with or displayed for the product.
ALPWEAR is not responsible for deterioration caused solely by use or treatment contrary to clear and reasonable care instructions, where the product itself was conforming.
This section does not limit statutory rights where care instructions are incorrect, insufficient or where the product was already non-conforming.
16. INTELLECTUAL PROPERTY
The ALPWEAR website and its original content, including trademarks, logos, brand names, collection names, graphics, artwork, product photography, video, written stories, layouts and other original material, are owned by or licensed to ALPWEAR and are protected by applicable intellectual-property laws.
You may use the website for personal and lawful purposes.
Without prior written permission, you may not commercially reproduce, copy, republish, sell, distribute, modify or exploit ALPWEAR-owned content, branding or artwork except where applicable law expressly permits this.
No intellectual-property right is transferred to you merely because you purchase an ALPWEAR product.
17. REVIEWS, FEEDBACK AND USER CONTENT
If you voluntarily submit a review, photograph, video, suggestion or other content to ALPWEAR and you have the right to share it, you grant ALPWEAR a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating, improving and promoting ALPWEAR, subject to applicable privacy and consumer-protection law.
You remain responsible for ensuring that content you submit does not unlawfully infringe another person’s rights.
We may remove or moderate content where we reasonably believe it is unlawful, fraudulent, abusive, unrelated to the product or service, contains personal data that should not be public, or otherwise violates lawful platform rules.
We will not treat a genuine negative review as prohibited merely because it is negative.
18. SHOPIFY AND THIRD-PARTY SERVICES
Our online store is powered by Shopify.
Shopify provides ecommerce technology and infrastructure but is not the seller of ALPWEAR products unless explicitly stated otherwise.
Certain features may also involve third parties, including payment providers, delivery carriers, review platforms, analytics providers or social-media services.
Where a third party provides a separate service directly to you, its own terms may also apply.
ALPWEAR remains responsible for its own legal obligations as the seller and does not use this section to exclude obligations that cannot legally be transferred to a third party.
19. WEBSITE AVAILABILITY AND TECHNICAL ERRORS
We may maintain, update, modify or temporarily suspend parts of the website where reasonably necessary for security, maintenance, technical, legal or operational reasons.
We do not guarantee that the website will always be available without interruption or technical error.
If a technical malfunction materially affects an order, we will correct the issue in accordance with applicable law and any binding agreement already concluded.
We may correct typographical, technical or factual errors on the website for future use. Corrections do not allow us to retrospectively deprive consumers of rights they have already validly acquired, except in cases such as a clear and unmistakable error recognized by law.
20. PROHIBITED USE
You may not use the website or Services to:
• violate applicable law;
• commit fraud or payment abuse;
• infringe intellectual-property or privacy rights;
• distribute malware or malicious code;
• interfere with the security or proper operation of the website;
• scrape, crawl or access the website in an abusive automated manner;
• impersonate another person;
• collect personal data unlawfully;
• harass, threaten or abuse others through our Services; or
• attempt to bypass technical purchase, security or fraud-prevention measures.
We may take proportionate measures, including restricting account access or refusing future orders, where we have reasonable grounds to believe these rules have been materially violated.
Such measures do not remove rights arising from valid existing consumer contracts.
21. SUSPENSION OR TERMINATION OF ACCESS
We may suspend or terminate access to non-essential account or website features where reasonably necessary because of:
• fraud or security concerns;
• unlawful conduct;
• serious or repeated breach of these Terms; or
• technical or legal requirements.
Where reasonably possible and appropriate, we will provide notice.
Termination of website or account access does not remove payment, delivery, refund, guarantee or other rights and obligations relating to an existing purchase.
22. EVENTS BEYOND OUR REASONABLE CONTROL
ALPWEAR is not responsible for a failure or delay caused solely by events beyond our reasonable control to the extent permitted by law.
Examples may include severe transport disruption, natural disasters, war, government restrictions, major network outages, customs disruptions, labour disruptions or serious supplier failures that could not reasonably have been prevented.
We will take reasonable steps to reduce the impact of such events.
This section does not exclude statutory rights to cancel, obtain a refund or pursue another remedy where the law grants those rights because delivery or performance has become impossible or excessively delayed.
23. LIABILITY
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
In particular, these Terms do not exclude mandatory liability arising from statutory consumer rights, product safety rules, fraud, deliberate misconduct, or any other liability that applicable law does not allow us to exclude.
To the extent permitted by law, ALPWEAR is not liable for losses that:
• were caused by your unlawful or improper use of the website or product;
• result solely from your failure to follow clear and reasonable product-care or security instructions;
• are caused solely by an independent third-party service for which ALPWEAR is not legally responsible; or
• are indirect or not reasonably foreseeable at the time the agreement was concluded.
Where ALPWEAR is legally liable, liability is limited only to the extent that applicable law permits such limitation.
Nothing in this section affects your right to a statutory remedy for a defective, incorrect, unsafe or non-conforming product.
24. PRIVACY
Our processing of personal data is governed by our Privacy Policy.
Where a third party, such as Shopify or a payment provider, acts as an independent controller for a separate service, its own privacy notice may also apply.
25. TRANSFER OF OUR BUSINESS
ALPWEAR may transfer rights and obligations connected with the business as part of a lawful restructuring, sale or transfer of the business.
A transfer will not reduce mandatory consumer guarantees or other statutory rights.
You may not transfer contractual obligations that are personal to you where this would materially prejudice ALPWEAR, unless the law gives you the right to do so.
26. CHANGES TO THESE TERMS
We may update these Terms for future use to reflect changes to our business, website, products, service providers or applicable law.
The version that applied when a purchase agreement was concluded continues to govern that purchase unless the law allows or requires otherwise or you expressly agree to a valid change.
We will not use a later version of these Terms to retroactively remove rights from a completed consumer purchase.
The latest version will be published on our website together with its update date.
27. SEVERABILITY
If a provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will apply only to the extent legally permitted.
Where possible, the remaining provisions continue in effect.
Nothing in this section allows an invalid consumer term to be replaced by another term that gives the consumer less protection than mandatory law.
28. GOVERNING LAW AND DISPUTES
These Terms and purchase agreements with ALPWEAR are governed by Dutch law.
If you are a consumer living in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the law that cannot contractually be excluded.
Before starting formal proceedings, we encourage you to contact us so that we can try to resolve the issue directly.
Any dispute may be brought before the competent court determined by applicable law. These Terms do not require a consumer to bring proceedings exclusively before a court where such a restriction would be unlawful.
